Welcome to Snik (the “Platform/Application”), which is a part of TechIndis Private Limited in India (collectively such entities will be referred to as “Snik”, “we” or “us”).
You are understanding the terms of service, which manage the relationship and serve as a contract between User i.e., you and us i.e. Snik and set forth the terms and conditions by which you may access and use the application and our related websites, services, platforms, products and content (collectively, known as the “Services”). Access to our Services or features of the application (such as, for example which is not limited to, or the ability to submit or share User Content (described below) may be subject to age limits and possibly not available to all users of the Services. Our Services are completely for self-use only and not available for commercial use. For purposes of these Terms, “you” and “your” means you as the user of the Services.
* This Terms of use Document is an electronic record which is under The Information Technology Act, 2000. This is a computer-generated record and I t doesn’t require any physical or digital signatures.
* “User/s”, “you”, “your” or “user/s” means a genuine and legal person who is accessing our website and mobile application of any platform associated with Snik app and bound by the Terms and Conditions and Terms of Use.
* “Company, We, Us, Our, we or organization” as used for Snik or TechIndis private Limited and his associates.
* “Profile” means a genuine and unique User account created from an individual and sole user at our mobile application created while using first time.
* “Affiliates” or “Publisher” or “Affiliate/Ad Networks” as the entities which are associates of Snik app in the marketing and advertising promotional ways.
* “Snik platform” OR “platform” means and refers to this online marketing Social Media and Entertainment company known as ‘Snik’ which connects users to Create, Upload, Like, Share, Refer on our platform along with interaction with each other via our platform and also enables users to participate in Contests, Create trends, purchase Coins, transfer Coins, Withdrawal of earning rewards and our ‘Client/Vendors’ to advertise their services, products on our platform sharing promotional offers, enabling quiz & surveys with sweepstakes to the Snik platform consumption are deemed Non-Confidential. We recommend our users to keep a caution and not to share and contribute such information, content and materials which are Private and confidential.
The Snik mobile application can be:-
* Pre-burn within your mobile/tablet or any other Smart Device (collectively called as ‘Device’).
* Download & Installed from a third-party source (Snik promotional partners).
* Downloaded from Google Play Store.
* Viewed on our website (www.snik.live).
THESE GIVEN TERMS AND CONDITIONS FORM A LEGALLY BIDING AGREEMETN BETWEEN USERS (YOU) AND SNIK (US/COMPANY). WE URGE AND RECOMMEND YOU TO READ THEM CAREFULLY AND FOLLOW THEM ACCORDINGLY AT SNIK PLATFORM.
* You being an individual user and sole owner of the account created at Snik, are automatically bound to follow the user Terms & Conditions and officially follow the contract with Snik and you agree to comply with them. You consent to the Terms & Conditions, our Privacy Policy and community guidelines by accessing our Services which are available on our Platform, on our Mobile Android/iOS applications and anywhere related to Snik.
* If you are an business entity or a registered corporation and accessing our services, then you consent to our services as an authorized representative of the business or entity with the authority to bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf, and your business or entity is legally and financially responsible for your access or use of the Services as well as for the access or use of your account by others affiliated with your entity, including any employees, agents or contractors.
* Please understand that by accessing our services, you are automatically giving your acceptance on the user agreement terms and conditions and we always recommend you to carefully read our user agreement terms.
If you do not agree to the terms and conditions of this Privacy Policy, please do not access our platform and do not use our Service.
* You confirm that access of Snik platform from your account is solely your responsibility and, in your possession, only. We only approve access to the user to our platform only if a User is 18 (eighteen) years of age or older and are legally capable of entering into a binding contract as per applicable law, including, in particular, the Indian Contract Act, 1872. Company reserves the complete right to terminate/band your account and / or refuse to provide you or your account access to our application/platform. Also, if this comes in company notice that the information disclosed by you while registering to the platform are incorrect and if it is found that you being a user is below the defined age or if you are a minor, insolvent or in any manner barred from entering into a contract. If You are under eighteen years of age, then you are advised and recommended as well as we consider it that you are purchasing products or use the SNIK Platform through your legal guardian permission and under their guidance which is as per the applicable laws. The Snik Platform is for adults and not intended for minors under the age of eighteen years or any other defined age in your respective country. If you become aware that any child has provided personal information without the essential legal guardian consent, please reach our customer support team at support@snik.live to report. Regardless of which location you reside or supply information from, you authorize Snik to store and/or use the Information according to this Privacy Policy in any country where Snik is or may operate.
* Since Snik is completely an electronic platform and when our users use the platform, chat with each other or transfer gifts to each other or send emails or other data, information or communication to Us is completely electronic mode and You consent to receive communications via electronic records or otherwise from Us periodically to the electronic or residential address provided to us at the time of registration, and as and when required. Snik or TechIndis company can communicate with you via different communication modes defined by company.
* Since we are a complete electronic platform, so we make sure that the app works smoothly and efficiently but at the same time we understand that it all depends on several factors like availability of Internet, speed, bandwidth which can creates issues at time and can result in malfunction which are completely beyond our control and cannot be guaranteed. There can be instances where platform can go to the maintenance stage or any other repair works for the well-functioning of the platform or to add new features and function to the platform at any time with/without any prior notification. Nevertheless, whatever conflicting, the Company reserves the complete right to refuse/deny access to the Platform to new users or to terminate access granted to existing Users at any time.
* Snik platform is available in PAN India basis and you can use if our services are available to your location and can create and upload content. We do not demonstrate that Content and/or Data on the SNIK Platform are suitable or available for use in user locations outside India or that the SNIK Platform complies with any country's privacy laws. Accessing the SNIK Platform from territories where the Content is considered illegal, is prohibited. It is your sole responsibility and we assume that it is you who do so on Your own initiative and are responsible for compliance with local laws.
* User Registration is mandatory process to access our platform and services and a user need to share the mandatory information asked in the account registration (including but not limited to name, email address, contact phone number, age, gender, KYC Documents, financial details, GST details where applicable, etc) and subsequently creating a Profile. Every user will be assigned with a User name and password which will be linked with your profile after successful registration. All the account information as for self-use only and are non-transferable in any manner and we recommend to keep the account information to be confidential and, in your possession, as you will be solely responsible for all acts or omissions committed on the Platform using Your username or password and for all the information / content posted under Your Profile. User are advised not to sell, trade, or transfer their Profiles to secondary users. If you are a company registering to our platform then it is your responsibility for the account which you or your designated employee access the account.
* Upon creating a Profile on Snik platform, we assume that the Profile created by a User is accurate and lawfully correct in all manners and genuine and will be banned or restricted to the access if found violating the rules and terms of Use.
* We assume that it is you who is accessing the created account and if in any case you find that its somebody else who is accessing your profile or have an access to your account then you will immediately notify the Company of any unauthorized use of Your Profile or any other breach of security, and ensure that you sign out/exit from your account immediately. You are advised that in all such instances you should not use your account with the existing details on our platform until unless the issue has been resolved completely to avoid any further loss of data. Company is not liable for any loss or damage arising from your failure to comply with these requirements.
* Further company do not have/share any liability in the event of any personal data or any financial loss or any form of damages due to the incorrect information or due to any shared login activities provided by the user of the SNIK Platform. It is user who is solely responsible for the activity that carried through your account whether or not you have authorized such activities or actions and shall, at all times, keep the Company indemnified in this regard and you must keep your account information secured and saved. Snik platform is only available to the account holders at Snik and to his/her representatives and you share consent to this. Violation of the platform use in unauthorized or unlawful ways will be treated as criminal act and will be linked with civil liability in accordance with the law of the land.
* Since company believes on users and their information which they share with us while creating a particular profile as we do not scan the profile before account creation. However, the Company reserve complete rights in accordance with applicable law to monitor or analyze your profile as well as the content which you have posted on to Snik platform and take necessary action not limited to delete, ban, restrict if found violating the Terms of Use or any applicable law. Any content, video found irrelevant or complained by other users or from any brand or company will be immediately go to the scanning process and the respective user can be prosecuted for the clarification and it cannot be in any manner, disaffirm or dilute the Company’s position as an intermediary or impose any liability on the Company with respect to User Content.
* User personal information (like Location, IP address, browser, Mobile no) can be used for promotional and other communication like suggesting new features, new product addition updates (including via calls, SMS, e-mail, Whatsapp, Telegram or other such means of communications) and You share your consent to use of such information by accessing our platform and processed in accordance with the provisions of the Privacy Policy. Our Privacy Policy explains completely how Snik collect, use and share your data when You use Snik Platform. It is in user capability if they do not want advertisements, updated and notification, they can change the setting by logging to their respective accounts.
* Snik wants to make sure that your information is accurate and up to date to provide you all the notifications and updates. Furthermore, you may ask to modify, correct or remove information with the tools and account settings of the App, or otherwise by contacting Snik customer support team via online chant and email options.

* You agree, acknowledge and share your consent that the Snik platform is for entertainment purpose keep a note that it will not harm other user (not limited to single person, brand, company, organization or others which can be objectional) sentiments. You may not use any products available on the Platform for any illegal or unauthorized purpose.
* Any unlawful or misuse of or Snik Platform to purchase or withdraw money from system which can cause any financial loss to the Company as a result of your action/inaction shall be completely recovered from You. Without prejudice to the above, the Company reserves the complete right to initiate legal proceedings against the defined user i.e. You for the fraudulent use of this Platform and/ or the Platform or for any other unlawful act or omission in breach of these Terms.
* The platform is for use of advertisements and promotions by our associate clients and vendors.
* You shall be responsible for checking the Content, product description and other related information given on the platform.
* Your purchase of Gift Cards, or Diamond or any other product from the platform is completely by your confirmation and you share consent that the product(s) bought by you are purchased for your internal / personal purpose and not for re-sale or business purpose. You bound by our Terms of Use wherein we, as a company can announce and provide declaration to any governmental authority on your behalf stating the aforesaid purpose of the products ordered by you on the website.
* We have built systems wherein we restrict our associate merchants from proposing to sell any forbidden items/products on the Platform. However, you understand and acknowledge that as a buyer it is also Your responsibility to make sure that you say no to the products which are prohibited with us which can be (a) Adult products and pornographic materials (including child pornography) in any form (print, audio/video, multimedia messages, images, photographs, etc.) (b) Alcohol (c) Animals and wildlife products – examples include live animals, mounted specimens, and ivory (d) Electronic surveillance equipment barred by law (e) Endangered species of animals and plants, whether alive or dead (f) or any other items which are prohibited, restricted, hazardous, fireworks, Lottery tickets, personal information, drugs, offensive or any other sanctioned or prohibited items or services as per applicable laws; and any other item deemed unfit by Company.
We always committed to make our platform for a public use and to make the platform where no body either our sellers, clients or our users offer any product or services which is not appropriate and objectionable to advertise, publish or sell. And to make this process more strong and solid we believe that both our associates understand and acknowledge that as a client and as a user you will not entertain any item which belongs to below but not limited to these only categories on our platform:
* Pornography, adult products and pornographic materials in any form.
* Alcohol related products & services.
* Weapons, firearms, and knives and other harmful and dangerous equipment.
* Animals and wildlife products showcasing selling and buying.
* Electronic surveillance equipment prohibited by law authorities.
* Prohibited goods from banned countries.
* Online tickets which are prohibited by Indian law.
* Grey market products.
* Any item related to Indian government which is prohibited by law.
* Government issued documents like Aadhar Card, PAN Car, Passports and many other confidential documents.
* Human remains and body parts.
* Financial documents for Individual and government.
* Lottery & gambling tickets.
* Indian nation country Maps and literature where Indian external boundaries have been shown falsely.
* Narcotic drugs and psychotropic substances prohibited by law.
* Offensive and objectionable material against particular person, religion, community, caste, sex or culture.
* Animals selling and animal body party skins.
* Sex determination Kits which is prohibited by law.
* Stolen property, Tobacco.
* Any other sanctioned or prohibited items or services as per applicable laws; and
* Any other item deemed unfit by Company.
As between you and Snik, all content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music on and “look and feel” of the Services, and all intellectual property rights related thereto (the “Snik Content”), are either owned or licensed by Snik, it being understood that you or your licensors will own any User Content (as defined below) you upload or transmit through the Services.
CONTENT RESTRICTIONS:
(a) You are not allowed to copy, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose whatsoever without our or, where applicable, our licensors’ prior written consent. We and our licensors reserve all rights not expressly granted in and to their content.
(b) You acknowledge that you will not make any alterations to, or modifications of, the whole or any part of Snik platform, or permit the Snik Platform or any part of it to be combined with, or become incorporated in, any other programs including any root software.
(c) You acknowledge that you will not use the Snik Platform in an unlawful manner, for any forbidden purpose, or in any manner unpredictable with these Terms, or act fraudulently or unkindly, for example, by trying to hack into or inserting malicious injection by software or viruses or other harmful data, into Snik Platform or any operating system and shall at all times remain compliant with laws applicable to Your use of Snik Platform.
(d) You acknowledge that you will not trespass Company intellectual property rights or those of any third party or any license terms in relation to Your use of Snik Platform or any service associated.
(e) You acknowledge that you will not use the Snik Platform in a way that could damage, harm company reputation in any manner.
(f) You acknowledge that you will not use the Snik content in any unlawful manner which violates the terms of use.
(g) You acknowledge that you will not use the content for any commercial, promotional, advertorial, endorsement, advertising or merchandising purpose until unless specified by Snik team. You acknowledge and agree that Snik may terminate this license at any time for any reason or no reason.
(h) You acknowledge that you will not re-sell, reproduce, download, publish, copy, create, or use the Content showcased on Snik Platform until unless permitted to share or copy by Snik team.
(i) You acknowledge that the content available on Snik platform is gathered and created from different users from their own creations or collections and we are not responsible for the complete accuracy, usefulness, safety, or intellectual property rights of or relating to such Content. We believe that you understand and acknowledge this and share your consent that the content available and displayed on our platform may be inaccurate, offensive, indecent, or objectionable, and You agree to waive, and hereby do waive, any legal or equitable rights or remedies You have or may have against Company with respect thereto.
(j) You acknowledge and agree that when you view content provided by others on the Services, you are doing so at your own risk. The content on our Services is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Services.
(k) You acknowledge that we make no representations, warranties or guarantees, whether express or implied, that any Snik Content (including different User Content) is correct, complete or up to date. Where our Services contain links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. You acknowledge that we have no obligation to pre-screen, monitor, review, or edit any content posted by you and other users on the Services (including User Content).
(l) We also have the right to disclose your identity to any third party who is claiming that any User Content posted or uploaded by you to our Services constitutes a violation of their intellectual property rights, or of their right to privacy.
(a) Users of the Services on our platform may be permitted to upload, post or transmit (such as via a stream) or otherwise make available content through the Services including, without limitation, any text, photographs, user videos, sound recordings and the musical works embodied therein, including videos that incorporate locally stored sound recordings from your personal music library and ambient noise (“User Content”). You shall be solely responsible for Your Materials and the consequences of submitting and publishing your Materials on the SNIK Platform. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to broadcast materials that you submit; and you license to Company all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Snik Platform pursuant to these Terms. You may remove your content from our Platform at any time. You must remove your materials if you no longer have the rights required by these Terms.
(b) You acknowledge and share your consent that whenever you access or use a feature that allows you to upload or transmit User Content through the Services (including via certain third-party social media platforms such as Instagram, Facebook, YouTube, Twitter), or to make contact with other users of the Services, you must comply with the standards set out at “Your Access to and Use of Our Services” above. We believe that you understand that if you decide to do this, you must comply with their content guidelines as well as with the standards set out at “Your Access to and Use of Our Services” above. Furthermore, you warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
(c)You acknowledge that your Content will be considered non-confidential and non-proprietary and you must not post any User Content on or through the platform or transmit to us any User Content that you consider to be confidential or proprietary. When you submit User Content through the Platform, you agree and represent that you own that User Content, or you have received all necessary permissions, clearances from, or are authorized by, the owner of any part of the content to submit it to the Services, to transmit it from the Services to other third-party platforms, and/or adopt any third-party content.
(d) You acknowledge that you or the owner of your Content still own the copyright in User Content sent or published on our platform, but by submitting User Content via the Platform, you hereby grant us an unconditional irretrievable, non-exclusive, royalty-free, fully transferable, permanent worldwide license to use, modify, adapt, produce, make byproduct works of, publish and/or transmit, and/or distribute and to authorize other users of the Services and other third-parties to view, access, use, download, modify, adapt, reproduce, make derivative works of, publish and/or transmit your User Content in any format and on any platform, either now known or hereinafter invented.
(e) You acknowledge and grant us a royalty-free license to use your user name, image, voice, and likeness to identify you as the source of any of your Content; provided, however, that your ability to provide an image, voice, and likeness may be subject to limitations due to age restrictions.
(f) You acknowledge that you being from Musical Works and for Recording Artists and being a music composer or author of a musical work and are affiliated with any musical group or company then you have to notify your associates of the royalty-free license you grant through these Terms in your User Content to us. You are exclusively responsible for ensuring your compliance with the relevant music house reporting obligations. If you have assigned your rights to a music publisher, then you must obtain the consent of such music publisher to grant the royalty-free license(s) set forth in these Terms in your User Content or have such music publisher enter into these Terms with us. You have to complete all the formalities, obligations and necessities from your associates as we will not be held responsible for any legal compliance using your content at our platform.
(g) You are the owner of your profile and your account and you have full control whether your Content is made publicly available on the Services to all other users of the platform or only available to people you approve. To restrict access to your User Content, you should select the privacy setting available within the Platform.
(h) You being a User of our platform acknowledge that if you are uploading and providing a paid promotion and advertising any brand promotions and market someone else via paid amounts then you have to indicate it clearly that the specific content belongs to paid promotions and include appropriate disclaimers and disclosures as required under applicable laws (including Infotech Laws), relevant industry body guidelines, and any other guidelines applicable to the sponsoring brands, products and services You are promoting, advertising or marketing.
(i) You conclusively grant us constant and unlimited permission to reproduce, distribute, create derivative works of, modify, publicly perform (including on a through-to-the-audience basis), communicate to the public, make available, publicly display, and otherwise use and exploit the Feedback and derivatives thereof for any purpose and without restriction, free of charge and without attribution of any kind, including by making, using, selling, offering for sale, importing, and promoting commercial products and services that incorporate or embody Feedback, whether in whole or in part, and whether as provided or as modified.
(j) You acknowledge that any information obtained by you as of result of your use of the services will be correct and reliable and any bug or issue in the application or software will be corrected to make it bug free and uninterrupted flow of service to you. There is no condition or warranty apply to the platform and its services except to the extent that they are expressly set out in the terms of use. Company reserves the complete right to change, suspend, withdraw or restrict the complete availability or any part of the services of our platform and operation due to any reasons and at any given point of time without any prior notice.
(k) We believe that you understand and acknowledge that nothing in the Terms of Use contract shall affect any stator rights that you cannot contractually agree to alter or waive and are legally entitle to as a consumer.
(l) You acknowledge that you will not post and publish a content which is unlawful, bullying, insulting, abusive, troublesome, defamatory, libelous, misleading, fake, offensive of another user’s privacy, or it contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates Company’s content guidelines, rules or policies.
(m) You acknowledge that you will not post any content which harmful and hateful for minors in anyway or is hateful, racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling or any other unlawful activities.
(n) You acknowledge that you will not post any content which is against any religion or make any community victimizes, degrades an individual or group of individuals based on religion, gender, sexual orientation, race, ethnicity, age, disability, or other legally protected basis.
(o) You acknowledge that you will not post any content which belongs to another person and is objectionable by that user and you do not reserve a right to post it.
(p) You acknowledge that you will not post any content which constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as "spamming").
Snik is a social media and Entertainment platform providing user a facility to interact with each other’s as well as to the Sellers and owners of the Product and services starting from Clothes & Accessories, Electronics & Mobiles, Health & Beauty, Sports & Fitness Products, Software Services, Matrimony services and so many others. The owner of the product and services advertise, display, and market their product and services to make them available for publish and it is a user sole responsibility to buy or use those services and products. The Platform merely facilitates the engagement of the Users and various Sellers and provides such other services as are incidental and supplementary to it. Additionally, the Platform reserves the right to terminate the services offered at any time to the Users without any notice
* All Products & Services demonstrated on the platform are on an “as is” and “as available” basis. All the material representing the product and services is actually from other sellers and user irrespective the involvement of Snik. We suggest our users to watch carefully and double sure before interacting with those as the actually image or description may vary. The platform is not responsible of the discrepancy of any kind which buying these until unless it is specified by the Snik admin. Company doesn’t warranty or guarantee until unless these are company displayed product & services will meet Your expectations, or that any errors in the services will be corrected. The merchants/sellers and users will be solely responsible for the same.
* The usability, durability and the quality of any products, services, information, or other material purchased or obtained by you through the Platform is not handled by Snik until unless it is specified and is the sole liability of the respective Seller.
* Company reserves the complete rights to stop selling, purchasing of any product or services and that to any location, region without any prior notice. Any change in the description, price, quantity is as per buyer & seller sole description. We reserve the right to suspend or discontinue any product at any time. Any offer for any product made on this Platform is void where prohibited.
* The prices mentioned on the products, services & gift cards may or may not come with any applicable taxes (VAT/CST, service tax, Goods and Services Tax ("GST"), duties and cesses). A buyer is solely responsible to the payments they are doing in respect to the purchase of those product & services.
* Company is not liable to any modification, price change, suspension or discontinuance of the services, the Platform. We may reserve the complete right to discontinue or suspend the services without prior notice.
* The “Product/Service Catalogue” means the Services offered by Snik with the help on our merchandising and gift card generation partners which we call them manufacturers, sellers, wholesalers, retailers, Users, suppliers, brokers, agents, and / or traders of steel and its products on the Website.
* Snik shall make an endeavor to ascertain the completeness, truthfulness, correctness of such information posted under the Products catalogue.
* However, notwithstanding anything, Snik shall not be liable and / or responsible to any person for any loss, damage, costs, expenses, claims and / or liability arising in any form whatsoever due to any action taken by such person pursuant to such information, usage of such information.
* Snik reserve a complete right to amend, change and / or withdraw the information posted under the Product Catalogue.
* All the products and services along with Gift Cards are associated with their prices which are in Indian Currency i.e. Rupees. Prices for Products and services are offered by the respective clients and they can be changed at any point of time with or without any prior notification by them. We believe that a User understand the pricing structure and share acknowledgement that by initiating a transaction, you are entering into a legally binding and enforceable contract with the product & services agreement to purchase the products using such payment facilities as may be permitted by applicable laws and as may be accepted by the Platform.
* The registration is completely FREE for everyone and we do not charge any registration or membership or browsing fee from anybody. However, we reserve the complete right to modify the fee policy from time to time. In the event of change of the services fee or any alteration to the existing fee then the charge will be intimated to the Users and such change shall automatically become effective immediately from date or change or introduction and immediately after they are posted on the Platform.
* The Snik platform works with third-party payment service providers which are called as payment gateways for collection of payments via our platform and for any return or refund will be as per their terms and conditions. The Platform shall collect the payment once the product or service or gift card is purchased by customer and after a successful transaction. User can note the transaction id, date of transaction and other important information about the particular transaction in their account under the order history page.
* User acknowledge that all payment and delivery related conditions are in accordance with the contractual relationship established between the Seller of the Products and the User purchasing the same and payment facility provided by the Platform is merely used by the User and Seller of the Product to facilitate the completion of the purchase made by the User.
* The Platform shall not be responsible for any damages, interests or claims arising from not processing a transaction. * We believe that you acknowledge that you being an end user agrees to provide accurate information, such as credit/debit information for purchasing Products on the Platform and that belongs to your or your organization (in case when you are making purchase on behalf of your organization) and the respective payment methods are not stolen or hacked in any manner. Every User further warrant that he/she shall not use payment information or instrument that is not lawfully owned by the User or belongs to a different user. The Platform is not responsible any claims after successful transaction that the particular payment method is falsely used by other user. The Platform disclaims all liabilities arising out of loss of any information pertaining to the Confidentiality of the credit/debit card details or pre-paid instrument account. In addition to the payment Terms, the terms and conditions of the bank or payment gateway shall also be applicable to every User. * In the event, the User fails to cure such issues within 30 (thirty) business days of receipt of such notice, or, if the User commits breach of any of the material provisions of the Terms of Use, then Snik shall, without prejudice to any other rights that it may have, be entitled to Suspend/Delete the Registration; Terminate the account; Restrict User access on the Website or part thereof; Recover any financial loss, to any other User, if any; and / or other action that Snik deems fit.
* Snik at its sole discretion may restrict, suspend or block your Registration without giving any explanation, if found violation our Terms of Use or if you misuse our Services. This includes but not limited to creating false/fake profile; placing fake orders; abusing our messaging services; use of your registration for scamming purposes; performing unlawful activities through our website; providing half or insufficient information about the business; infringing any intellectual property rights, or any other behaviour that affects us. Found a User guilty of violation of Terms of Use will be completely blocked from our end and will not be allowed to become a member again at a later date. Account termination may be permanent, at the sole and absolute discretion of Snik.

The Terms of Use shall be governed by the laws of India shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana, India.
The Terms of Use shall not establish or constitute any relationship of partnership, joint venture, franchise, employment or agency between Snik and the User and both shall continue to be independent of each other and neither of them shall have the power to bind the other without the other’s prior written consent.
The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of any provision herein in any manner whatsoever.
Neither party hereto shall be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by, among other things, strikes, lock-out, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences.
The User acknowledges that the Terms of Use contains the entire agreement between the User and Snik as per mutual understanding between the User and Snik Platform.
